Terms of Service

1. Acceptance of Terms

Welcome to Feelr. These Terms of Service ("Terms") govern your access to and use of the Feelr mobile application and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Eligibility

To use Feelr, you must:

  • Be at least 17 years of age
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Service under applicable laws
  • Not have been previously banned or suspended from the Service

Users under 18 must have permission from a parent or guardian to use the Service.

3. Account Registration and Security

3.1 Account Creation

You may be required to create an account to access certain features of the Service. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access or security breach

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree not to:

  • Share your account with others
  • Create multiple accounts for the same person
  • Create accounts using automated means or false pretenses
  • Impersonate any person or entity

4. Zero Tolerance Policy for Objectionable Content and Abusive Behavior

WE HAVE ZERO TOLERANCE FOR OBJECTIONABLE CONTENT OR ABUSIVE USERS.

Prohibited Content and Behavior:

  • Harassment and Bullying: Any form of harassment, bullying, intimidation, or threatening behavior toward other users
  • Hate Speech: Content that promotes violence, discrimination, or hatred based on race, ethnicity, national origin, religion, sexual orientation, gender identity, disability, or any other protected characteristic
  • Sexually Explicit Content: Pornographic material, sexually explicit images, videos, or messages
  • Violence and Gore: Graphic violence, gore, or content that promotes self-harm or suicide
  • Illegal Activities: Content promoting illegal activities, including but not limited to drug use, trafficking, terrorism, or exploitation of minors
  • Child Safety: Any content that endangers or exploits minors in any way
  • Spam and Scams: Unsolicited commercial messages, phishing attempts, scams, or fraudulent content
  • Impersonation: Pretending to be someone else or creating fake profiles
  • Intellectual Property Violations: Sharing content that infringes on others' copyrights, trademarks, or intellectual property rights

Consequences:

Violation of this zero tolerance policy will result in immediate action, including but not limited to:

  • Immediate removal of objectionable content
  • Permanent ban from the platform
  • Reporting to law enforcement authorities when applicable
  • Legal action when appropriate

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Harass, abuse, threaten, or intimidate other users
  • Post or transmit hate speech, discriminatory content, or offensive material
  • Share sexually explicit content or content involving minors
  • Engage in spam, phishing, or fraudulent activities
  • Violate any local, state, national, or international law
  • Infringe upon the intellectual property rights of others
  • Distribute malware, viruses, or harmful code
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use automated tools, bots, or scrapers to access the Service
  • Reverse engineer, decompile, or disassemble any part of the Service

4.2 Content Reporting and Moderation

Easy Reporting: We provide an easy-to-use reporting system within the App. Users can report objectionable content or abusive behavior directly from user profiles or chat conversations.

24-Hour Response Commitment: We commit to reviewing all content reports within 24 hours and taking appropriate action, which may include:

  • Immediate removal of violating content
  • Warning the offending user
  • Temporary or permanent suspension of the offending user's account
  • Reporting to law enforcement when necessary

User Blocking: All users have the ability to block other users at any time, preventing further communication or interaction. Blocked users cannot see your profile or contact you.

4.3 User Content

You retain ownership of any content you submit to the Service ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content for the purpose of operating and improving the Service.

Content Removal: We reserve the right to remove any User Content at any time for any reason, including violation of these Terms. We may suspend or terminate accounts that repeatedly violate our policies.

5. Mood Matching and Service Features

5.1 Mood Data

The Service allows you to set your current mood and match with friends who have similar moods. Mood information is:

  • Temporary and expires after a set period
  • Only visible to your mutual friends
  • Used to facilitate connections based on your preferences

5.2 No Guarantee of Matches

We do not guarantee that you will match with specific users or receive any particular number of matches. The Service is provided on an "as-is" basis.

5.3 Contact Syncing

If you choose to sync your device contacts, you grant us permission to access and store phone numbers from your contacts to help you find friends on the platform and invite others to join.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

7. Intellectual Property Rights

7.1 Feelr Property

The Service and its original content, features, and functionality are owned by Feelr and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Trademarks

The Feelr name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Feelr. You may not use such marks without our prior written permission.

7.3 Copyright Infringement

If you believe that content on the Service infringes your copyright, please contact us at [email protected] with the following information:

  • Identification of the copyrighted work
  • Identification of the infringing material
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury
  • Your physical or electronic signature

8. Third-Party Services and Links

The Service may contain links to third-party websites or services that are not owned or controlled by Feelr. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

9. Subscription and Payment Terms

9.1 Free and Premium Features

Feelr offers both free and premium features. Premium features may require a paid subscription.

9.2 Subscription Terms

  • Subscriptions automatically renew unless cancelled before the renewal date
  • Payment will be charged to your payment method upon purchase confirmation
  • Subscriptions can be managed and cancelled through your device's account settings
  • Refunds are handled according to the app store's refund policy

9.3 Price Changes

We reserve the right to modify subscription prices with advance notice. Price changes will not affect active subscriptions until renewal.

10. Disclaimers

10.1 Service Availability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • The quality of any products, services, or information obtained through the Service will meet your expectations
  • Any errors in the Service will be corrected

10.2 Health and Safety

Feelr is a social connection platform and is not a substitute for professional mental health services. If you are experiencing a mental health crisis, please contact a qualified healthcare provider or emergency services.

10.3 User Interactions

We are not responsible for the conduct of any user of the Service, whether online or offline. You are solely responsible for your interactions with other users. We encourage you to exercise caution and good judgment in all interactions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEELR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Feelr and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Service
  • Your User Content
  • Your violation of any rights of another party

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

13.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

13.3 Effect of Termination

Upon termination:

  • Your right to access and use the Service will immediately cease
  • We may delete your account and User Content
  • Provisions of these Terms that by their nature should survive termination shall survive

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

14.2 Arbitration

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

  • Posting the updated Terms with a new "Last Updated" date
  • Sending an email notification to the address associated with your account
  • Providing an in-app notification

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

  • You agree to be bound by them
  • You understand that there is ZERO TOLERANCE for objectionable content or abusive behavior
  • You agree that violations will result in immediate action including account termination
  • You will treat other users with respect and report any violations you encounter

These Terms of Service constitute a legally binding agreement between you and Feelr.
